Contract Agreement:

Foxy Forest Poms Puppy Purchase Agreement & Health Guarantee

 

Reservations & Holds

 

A minimum deposit of **$500** is required to reserve and hold a puppy through the mutually agreed-upon pickup date.

 

All deposits received will be applied toward the purchase price of the puppy.

 

Deposits are non-refundable.

Limited / Full AKC Rights

 

All puppies are placed with **Limited AKC Registration**.

 

**Full AKC Breeding Rights** may be available for an additional fee and must be agreed upon prior to purchase.

 

---

 

Three-Year Health Guarantee

 

Foxy Forest Poms provides a **three-year health guarantee** for your puppy.

 

Our dams and sires are Embark DNA & Health tested. We utilize these results when making breeding decisions and selecting pairings, with the goal of producing healthy puppies and reducing the risk of inherited conditions known to affect the Pomeranian breed.

 

Copies of the parents' Embark DNA and Health results are available upon request to Buyers.

 

With Champions throughout our bloodlines, we carefully select our breeding pairs with the goal of producing healthy, quality Pomeranian puppies.

 

**Our three-year guarantee applies specifically to a health-related death resulting from a covered hereditary or congenital condition. Any significant health defect present at the time of purchase must be identified during the initial veterinary examination within seven days, as outlined below.**

Veterinary Examination

 

Buyer must have the puppy examined by a licensed private veterinarian within **seven days of purchase**.

 

The examination should assess the puppy for significant health defects or major faults that could substantially affect the puppy's normal quality or length of life. A copy of the veterinarian's findings must be provided to Seller.

 

Certain conditions, including an underbite, retained puppy teeth, luxating patella, or an open fontanelle, are not considered covered conditions under this guarantee.

Exchange for a Covered Health Defect

 

If a significant health problem, major fault, or covered congenital or hereditary defect is discovered during the initial seven-day veterinary examination, Buyer must provide Seller with written documentation of the diagnosis from the examining veterinarian.

 

Upon receipt of the veterinary documentation, Seller reserves the right to have the puppy examined by a veterinarian of Seller's choice for a second opinion.

 

If the condition is confirmed and determined to qualify under this Health Guarantee, Buyer may return the puppy to Seller, along with the original AKC paperwork and any other required documentation, for an equivalent replacement puppy.

 

If a suitable replacement puppy is not available at the time of the approved exchange, Buyer will be offered a replacement puppy from the next available litter.

 

Foxy Forest Poms is not responsible for veterinary expenses incurred by Buyer. All costs associated with returning or transporting a puppy for an approved exchange are the responsibility of Buyer.

 

Fees paid for shipping, handling, health certifications, transportation, and/or shipping crates are non-refundable.

Replacement Following a Covered Health-Related Death

 

If the puppy dies within the first **three years of life** as the direct result of a covered hereditary or congenital condition, Buyer must request that the attending veterinarian provide Seller with an official written statement of the cause of death within **three business days** of the puppy's passing.

 

The statement must be written on official veterinary letterhead and signed by the attending veterinarian. It must establish that the cause of death was directly attributable to a covered condition under this Health Guarantee.

 

Upon receipt and review of the required veterinary documentation, Seller will offer Buyer a replacement puppy from the most current litter available.

 

If a suitable replacement puppy is not available at that time, a replacement puppy will be offered from the next available litter.

 

Any replacement puppy provided under this Health Guarantee will be of comparable value, subject to availability.

Surrender Policy

 

Buyer understands and agrees, prior to purchase, to provide for the daily care and needs of the puppy.

 

Buyer understands that a new puppy requires ongoing potty training and that accidents may occur.

 

Buyer understands that a puppy may cry, whine, or become distressed when left alone or unattended.

 

Buyer agrees to provide a secure playpen, kennel, or appropriately fenced area to keep the puppy safe, including when outdoors.

 

Buyer understands that raising a puppy requires time, patience, consistency, and positive training using appropriate rewards and encouragement.

 

Buyer understands that puppy ownership comes with ongoing responsibilities and expenses, including veterinary care, grooming, training, food, and other routine needs.

 

Should a life circumstance arise that prevents Buyer from keeping the puppy, Buyer agrees to contact Foxy Forest Poms and voluntarily surrender the puppy to Seller rather than placing the puppy in a shelter or foster home.

 

Buyer agrees not to sell, transfer, or otherwise place the puppy with another party without first contacting Foxy Forest Poms.

 

Buyer may contact Foxy Forest Poms regarding surrender at any time without fear of backlash or judgment. Our priority is the safety and welfare of the puppy.

 

Seller will accept the puppy back when Buyer is transparent about the circumstances and provides the information necessary to determine an appropriate course of action.

 

**Surrendering a puppy does not automatically entitle Buyer to a refund.** Seller does not guarantee a full refund upon surrender. At Seller's discretion, a partial refund may be considered after the puppy has been evaluated by Seller's veterinarian and a suitable secondary forever home has been secured.

Health Requirements for Surrender

 

Should Buyer surrender the puppy, Buyer represents that, to the best of Buyer's knowledge, the puppy is in good health, current on required vaccinations, recently dewormed, and appropriately treated for fleas.

 

Buyer must surrender the puppy with all available veterinary records, the original AKC paperwork with a completed transfer of ownership signed by Buyer, and any other original documentation provided at the time of purchase.

 

If the puppy is displaying signs of illness—including coughing, diarrhea, fever, lethargy, fleas, mange, or other concerning symptoms—the puppy may not be returned to Foxy Forest Poms until the puppy has been appropriately examined and treated by a veterinarian and is sufficiently recovered to safely return.

 

Buyer acknowledges that Seller cannot safely receive a contagious or seriously ill puppy back into the household without appropriate veterinary clearance.

 

Any refund or partial refund approved by Seller will be issued only after a suitable secondary forever home has been secured for the puppy.

Routine Illnesses, Parasites & External Pests

 

Foxy Forest Poms does not guarantee against ordinary, non-life-threatening illnesses, parasites, or external pests that may occur in puppies and dogs as part of normal environmental exposure and routine veterinary care. This includes, but is not limited to, common conditions such as kennel cough, intestinal worms (including roundworms, hookworms, tapeworms, and whipworms), Giardia, coccidia, fleas, mites, ticks, and other common infectious organisms or parasites.

 

These conditions may be encountered even in puppies who have received appropriate veterinary care, deworming, preventative treatments, and vaccinations. Exposure can occur through soil, grass, water, other animals, veterinary facilities, or other environmental sources.

 

The presence of a parasite, infectious organism, or other routine condition does not, by itself, indicate that a puppy was unhealthy or improperly cared for prior to purchase. Such conditions are considered part of routine veterinary care and are the responsibility of the Buyer after the puppy leaves Foxy Forest Poms.

 

**These routine conditions are not eligible for a refund, exchange, or replacement under this Health Guarantee.** Foxy Forest Poms is not responsible for veterinary expenses associated with their diagnosis or treatment.

Buyer Acknowledgment

 

By purchasing a puppy from Foxy Forest Poms, Buyer acknowledges that they have read, understand, and agree to the terms of this Puppy Purchase Agreement and Health Guarantee.

 

Buyer understands that puppy ownership involves ongoing care, training, veterinary expenses, and responsibility for the puppy's health and well-being after leaving Foxy Forest Poms.

 

Buyer acknowledges that this Health Guarantee is limited to the specific conditions and circumstances expressly described above.
